Summary
How to Obtain and Use Prior Reports to Expose Bias of Expert Witnesses

Do you ever feel like the defense is using the same experts over and over again? And all of their reports say the same thing? Or at least the expert always seems to reach the same conclusion? Sam Elder has spent years collecting reports and repeatedly deposing experts to show their bias. On any individual case, it may appear that there is simply a disagreement between the plaintiff and defense experts. However, when you can demonstrate that the defense witness always finds no injury or disagrees with every treating doctor that they review, then a pattern of bias may emerge.

Elder, Jr. graduated from Linfield College (summa cum laude) in 1991. He received a Juris Doctorate from University of Washington in 1996 with Honors. Sam has been a WSAJ member since 1993. He became an Eagle member in 1998. He has practiced in Washington State since October 1996. He is currently the sole owner of Law Office of Sam Elder PLLC in Kirkland, Washington.

Sam has an active practice in the areas of personal injury, insurance coverage, insurance bad faith, and health care provider law. He brings special expertise in the application of courtroom technology to advocacy, developing innovative approaches to the cost-effective representation of his clients. His office has been paperless since 2007, and he has operated a virtual office since 2011. Sam has undertaken his “archivist” project of collecting reports on defense experts to show their pattern of bias against injured persons and treating health care providers.

Sam also served as the chair of the Law Office Management Assistance Program for the WSBA (2000-2002). He served on the WSTLA CLE committee, as chair of the WSTLA Eastside Roundtable, and on the WSAJ membership committee.

Sam authored the WSAJ Auto Accident Deskbook chapter on subrogation/reimbursement claims and district court litigation.

Sam has taught continuing legal education courses on a variety of topics including: how to try your first jury trial, various state law and federal subrogation and reimbursement topics, cross-examining biomechanical experts, comparisons of litigating cases in mandatory arbitration versus district court, strategies and tactics for mandatory arbitration litigation, and strategies and tactics for district court litigation, and how to manage cost effective litigation.   Read Less
