Summary
How do you avoid falling into the defense’s traps in a premises liability case? Often, the defendant refuses to provide any surveillance footage until you file a lawsuit. The defendant may claim there has never been a similar incident in the history of the building – and sometimes that is even true. The defendant may deny there was any problem, that they were ever aware of the problem, or that they had the power to fix it. Advance planning can help you get past these pitfalls.
